You can fool some people all the time and all the people sometimes, but not all the people all the time.

The Spirit of May Day Lives On!

In France, a Move to Limit Off-the-Clock Work Emails

PARIS: Given France’s 35-hour workweek, generous vacations and persistent, if not altogether accurate, reputation for indolence, it may come as a surprise that the French are only now considering limits on the work emails and phone calls that come at all hours of the day and night.
Labor unions and corporate representatives in France have agreed on an “obligation to disconnect from remote communications tools” that would apply to 250,000 employees of consulting, computing and polling firms. The accord, signed this month but yet to be approved by the Labor Ministry, would require that employers verify that the 11 hours of daily “rest” time to which all workers are legally entitled be spent uninterrupted.
“We really want there to be 11 consecutive hours,” said Marie Buard, a project leader at the Federation of Communication, Consulting and Culture, a branch of the French Democratic Confederation of Labor. Still, Ms. Buard said, “We also wouldn’t like this to squeeze businesses and cause them problems.”
Under the agreement, she said, each company would develop a policy and enforcement mechanisms. One might choose to block communications from 11 p.m. to 10 a.m. by shutting down its email servers, while another might simply ask employees not to check email between 9 p.m. and 8 a.m.
Similar limits have been tested elsewhere. In 2011, Volkswagen started shutting off its BlackBerry servers at the end of the workday, stopping some employees in Germany from sending or receiving emails. Last year, the German Labor Ministry ordered its supervisors not to contact employees outside office hours.
But the British press did not seem to notice the German precedents, and reveled at another opportunity to confirm scornful stereotypes about the French. Several websites, Twitter feeds and other news outlets in Britain lost no time in misconstruing the agreement on Thursday, asserting that France had banned email after 6 p.m. or that one million 35-hour-a-week workers would be covered by the accord.
The image of French people “who don’t get anything done, who just take vacations — that’s not what this is about at all,” said Max Balensi, an official with the Syntec federation, one of the employers’ groups that signed the accord. Mr. Balensi, who said he previously worked for Accenture and BP — not French companies — called such reports “disinformation.”

In fact, the agreement will affect perhaps 250,000 consultants and technology workers whose contracts stipulate only an annual number of workdays, but not daily working hours, said Frédérique Lebon, a spokeswoman for Cinov, another employers’ federation that signed the deal. The agreement is meant to establish safeguards that would ensure balance in the lives of employees, many of whom work with foreign companies in far-flung time zones, Ms. Lebon said.
“For us, it was extremely important to say that the employers in this sector are very attentive to the health of our employees,” she said.
French labor law is highly protective of workers’ rights, but businesses and even some officials in the French government say it is a significant impediment to economic growth. With the economy stagnant and the unemployment rate above 10 percent, President François Hollande has pledged billions of euros in tax cuts for businesses, part of a broader effort to make French companies more competitive.
Mr. Balensi, at Syntec, said, “If you don’t have employees who are in good health, your competitiveness is going to fall.”

Gabriel Garcia Marquez - Nobel Lecture

(March 6 1927 - April 18 2014)

Nobel Lecture

Nobel Lecture, 8 December, 1982
(Translation)

The Solitude of Latin America

Antonio Pigafetta, a Florentine navigator who went with Magellan on the first voyage around the world, wrote, upon his passage through our southern lands of America, a strictly accurate account that nonetheless resembles a venture into fantasy. In it he recorded that he had seen hogs with navels on their haunches, clawless birds whose hens laid eggs on the backs of their mates, and others still, resembling tongueless pelicans, with beaks like spoons. He wrote of having seen a misbegotten creature with the head and ears of a mule, a camel's body, the legs of a deer and the whinny of a horse. He described how the first native encountered in Patagonia was confronted with a mirror, whereupon that impassioned giant lost his senses to the terror of his own image.

This short and fascinating book, which even then contained the seeds of our present-day novels, is by no means the most staggering account of our reality in that age. The Chronicles of the Indies left us countless others. Eldorado, our so avidly sought and illusory land, appeared on numerous maps for many a long year, shifting its place and form to suit the fantasy of cartographers. In his search for the fountain of eternal youth, the mythical Alvar Núñez Cabeza de Vaca explored the north of Mexico for eight years, in a deluded expedition whose members devoured each other and only five of whom returned, of the six hundred who had undertaken it. One of the many unfathomed mysteries of that age is that of the eleven thousand mules, each loaded with one hundred pounds of gold, that left Cuzco one day to pay the ransom of Atahualpa and never reached their destination. Subsequently, in colonial times, hens were sold in Cartagena de Indias, that had been raised on alluvial land and whose gizzards contained tiny lumps of gold. One founder's lust for gold beset us until recently. As late as the last century, a German mission appointed to study the construction of an interoceanic railroad across the Isthmus of Panama concluded that the project was feasible on one condition: that the rails not be made of iron, which was scarce in the region, but of gold.

Our independence from Spanish domination did not put us beyond the reach of madness. General Antonio López de Santana, three times dictator of Mexico, held a magnificent funeral for the right leg he had lost in the so-called Pastry War. General Gabriel García Moreno ruled Ecuador for sixteen years as an absolute monarch; at his wake, the corpse was seated on the presidential chair, decked out in full-dress uniform and a protective layer of medals. General Maximiliano Hernández Martínez, the theosophical despot of El Salvador who had thirty thousand peasants slaughtered in a savage massacre, invented a pendulum to detect poison in his food, and had streetlamps draped in red paper to defeat an epidemic of scarlet fever. The statue to General Francisco Moraz´n erected in the main square of Tegucigalpa is actually one of Marshal Ney, purchased at a Paris warehouse of second-hand sculptures.

Eleven years ago, the Chilean Pablo Neruda, one of the outstanding poets of our time, enlightened this audience with his word. Since then, the Europeans of good will - and sometimes those of bad, as well - have been struck, with ever greater force, by the unearthly tidings of Latin America, that boundless realm of haunted men and historic women, whose unending obstinacy blurs into legend. We have not had a moment's rest. A promethean president, entrenched in his burning palace, died fighting an entire army, alone; and two suspicious airplane accidents, yet to be explained, cut short the life of another great-hearted president and that of a democratic soldier who had revived the dignity of his people. There have been five wars and seventeen military coups; there emerged a diabolic dictator who is carrying out, in God's name, the first Latin American ethnocide of our time. In the meantime, twenty million Latin American children died before the age of one - more than have been born in Europe since 1970. Those missing because of repression number nearly one hundred and twenty thousand, which is as if no one could account for all the inhabitants of Uppsala. Numerous women arrested while pregnant have given birth in Argentine prisons, yet nobody knows the whereabouts and identity of their children who were furtively adopted or sent to an orphanage by order of the military authorities. Because they tried to change this state of things, nearly two hundred thousand men and women have died throughout the continent, and over one hundred thousand have lost their lives in three small and ill-fated countries of Central America: Nicaragua, El Salvador and Guatemala. If this had happened in the United States, the corresponding figure would be that of one million six hundred thousand violent deaths in four years.

One million people have fled Chile, a country with a tradition of hospitality - that is, ten per cent of its population. Uruguay, a tiny nation of two and a half million inhabitants which considered itself the continent's most civilized country, has lost to exile one out of every five citizens. Since 1979, the civil war in El Salvador has produced almost one refugee every twenty minutes. The country that could be formed of all the exiles and forced emigrants of Latin America would have a population larger than that of Norway.

I dare to think that it is this outsized reality, and not just its literary expression, that has deserved the attention of the Swedish Academy of Letters. A reality not of paper, but one that lives within us and determines each instant of our countless daily deaths, and that nourishes a source of insatiable creativity, full of sorrow and beauty, of which this roving and nostalgic Colombian is but one cipher more, singled out by fortune. Poets and beggars, musicians and prophets, warriors and scoundrels, all creatures of that unbridled reality, we have had to ask but little of imagination, for our crucial problem has been a lack of conventional means to render our lives believable. This, my friends, is the crux of our solitude.

And if these difficulties, whose essence we share, hinder us, it is understandable that the rational talents on this side of the world, exalted in the contemplation of their own cultures, should have found themselves without valid means to interpret us. It is only natural that they insist on measuring us with the yardstick that they use for themselves, forgetting that the ravages of life are not the same for all, and that the quest of our own identity is just as arduous and bloody for us as it was for them. The interpretation of our reality through patterns not our own, serves only to make us ever more unknown, ever less free, ever more solitary. Venerable Europe would perhaps be more perceptive if it tried to see us in its own past. If only it recalled that London took three hundred years to build its first city wall, and three hundred years more to acquire a bishop; that Rome labored in a gloom of uncertainty for twenty centuries, until an Etruscan King anchored it in history; and that the peaceful Swiss of today, who feast us with their mild cheeses and apathetic watches, bloodied Europe as soldiers of fortune, as late as the Sixteenth Century. Even at the height of the Renaissance, twelve thousand lansquenets in the pay of the imperial armies sacked and devastated Rome and put eight thousand of its inhabitants to the sword.

I do not mean to embody the illusions of Tonio Kröger, whose dreams of uniting a chaste north to a passionate south were exalted here, fifty-three years ago, by Thomas Mann. But I do believe that those clear-sighted Europeans who struggle, here as well, for a more just and humane homeland, could help us far better if they reconsidered their way of seeing us. Solidarity with our dreams will not make us feel less alone, as long as it is not translated into concrete acts of legitimate support for all the peoples that assume the illusion of having a life of their own in the distribution of the world.

Latin America neither wants, nor has any reason, to be a pawn without a will of its own; nor is it merely wishful thinking that its quest for independence and originality should become a Western aspiration. However, the navigational advances that have narrowed such distances between our Americas and Europe seem, conversely, to have accentuated our cultural remoteness. Why is the originality so readily granted us in literature so mistrustfully denied us in our difficult attempts at social change? Why think that the social justice sought by progressive Europeans for their own countries cannot also be a goal for Latin America, with different methods for dissimilar conditions? No: the immeasurable violence and pain of our history are the result of age-old inequities and untold bitterness, and not a conspiracy plotted three thousand leagues from our home. But many European leaders and thinkers have thought so, with the childishness of old-timers who have forgotten the fruitful excess of their youth as if it were impossible to find another destiny than to live at the mercy of the two great masters of the world. This, my friends, is the very scale of our solitude.

In spite of this, to oppression, plundering and abandonment, we respond with life. Neither floods nor plagues, famines nor cataclysms, nor even the eternal wars of century upon century, have been able to subdue the persistent advantage of life over death. An advantage that grows and quickens: every year, there are seventy-four million more births than deaths, a sufficient number of new lives to multiply, each year, the population of New York sevenfold. Most of these births occur in the countries of least resources - including, of course, those of Latin America. Conversely, the most prosperous countries have succeeded in accumulating powers of destruction such as to annihilate, a hundred times over, not only all the human beings that have existed to this day, but also the totality of all living beings that have ever drawn breath on this planet of misfortune.

On a day like today, my master William Faulkner said, "I decline to accept the end of man". I would fall unworthy of standing in this place that was his, if I were not fully aware that the colossal tragedy he refused to recognize thirty-two years ago is now, for the first time since the beginning of humanity, nothing more than a simple scientific possibility. Faced with this awesome reality that must have seemed a mere utopia through all of human time, we, the inventors of tales, who will believe anything, feel entitled to believe that it is not yet too late to engage in the creation of the opposite utopia. A new and sweeping utopia of life, where no one will be able to decide for others how they die, where love will prove true and happiness be possible, and where the races condemned to one hundred years of solitude will have, at last and forever, a second opportunity on earth.

Is there really any Modi Wave?

Whats the Election Scenario?

Amit Sengupta

Just came back after voting for Rajmohan Gandhi. Feels good. A secular scholar, decent human being, and a man of integrity, i got him to write regularly for HT when i was handling the edit page during the sinister BJP-led NDA regime. The middle class is not disclosing, but the poor, Dalits, minorities and working class are upbeat and frank... they are voting for Rajmohan Gandhi in East Delhi, since "both the Congress and BJP are anti-poor, looters and plunderers" -- they say. People have seen through the obscene, multi-crore ad campaign backed by corporates and paid news urban media. "Baad mein hamara khoon choosenge," is the refrain. There is no Modi wave or 'hawa' here, or in UP or Bihar, reporters and locals on the ground are reporting. Nowhere..... It's all a pseudo media hype. No one cares a damn for the feku Gujarat Model in the Hindi heartland....

Except in parts of western UP where they have polarised votes on vicious communal and hate politics led by Amit Shah, even many constituencies here in the first phase of the polls might give a big surprise. There is very little chance that RLD of Ajit Singh and BSP will not gain in some of the constituencies, despite the hate polarisation, due to their old and traditional vote base. Hema Malini is surely losing in Mathura. Kairana and Saharanpur might go with BSP. In eastern UP, or Bihar, reporters on the ground have not spotted any hawa in support of Modi, and locals are yet again voting majorly on caste lines. BJP's ticket selection, internal dissension and Brahmins going against them will cost it dear. Even Rajnath Singh's seat in Lucknow is in a mess because Brahmins are strongly offended against the BJP in the Ganga-Jamuni belt and Rita Bahuguna Joshi's campaign is indeed gaining strong ground. So where is the Modi wave? Indeed, if the BJP president runs away from his old seat of Ghaziabad next to Delhi what is the message that goes in UP? So this hype about gaining 50 in UP and a huge number in Bihar is doubtful, with the Laloo factor becoming increasingly strong in Bihar.

In Delhi, the poor and deprived are overwhelmingly with AAP. Rakhi Birla too stands a strong chance in her reserved constituency. And so does Prof Anand Kumar who is giving a tough fight to the BJP.

I went to Northeast Delhi constituency with some old JNU friends to express solidarity with Prof Anand Kumar, our JNU senior, friend and teacher, and AAP Lok Sabha candidate. Some of us share the heady history of the JNU Students' Union with him as former presidents of JNUSU. There is no doubt that he has gained massive ground and is giving a tough fight to the BJP and the multi-crore paid news Modi's ghost which has been showcased everywhere. His Lok Sabha campaign is especially strong among the poor, working class, migrant workers, unorganised labourers, women, minorities, the middle classes, students, and teachers and staff of Delhi University and its colleges. His campaign has also broken the backbone of the so called celebrity BJP candidate's poorvanchal card (with deep pockets), among large sections of people from this region of the Hindi heartland. They are also backing Prof Anand Kumar. This is really an intensely and starkly backward, poor and neglected area, with hardworking people and the poor left to their fate by the Congress regime (and its MP) and earlier governments. People want hope and relief and a better life. Anand Kumar and his campaign by friends and supporters has struck a strong, popular and instant chord. He is giving a real solid fight to the BJP and can break the threshold of the victory margin.

The Myths of Cancer

Here is a path-breaking book on different facets of Cancer and the myths and business that surround it to fool people..

The Other Face of Cancer
by
Dr Manu Kothari & Dr Lopa Mehta

Some excerpts:
'The mythology of the whole field of cancerology is best summed up as colossal ignorance matched by overclaiming, overdoing and overpromising.'

'Cancerlogists overdo - overdiagnose and overtreat - because they refuse to accept the writing on the wall that no cancer can be diagnosed early enough, or can be treated to the point of a cure: the cancer therapist treats what he sees. The illusion of a cure following therapy lies mainly in the patient not feeling the presence of cancer and/or the clinician not being able to detect it. The classic example is that of acute leukemia where even in 'complete remission' the patient's body has a large number of cancer cells all the time.'

This book will raise the voices against those who profit from the continuing ignorance and hysteria over the disease. Interestingly, Nobel Laureates like J D Watson and M Burnet have vividly said about cancer research as 'scientifically bankrupt, therapeutically ineffective and wasteful.'

Ekak Matra will be carrying a review of this book in its May 2014 issue.

Arvind Kejriwal's Reply to Mukesh Ambani

Do you want to become the world's richest person through dishonesty?

Dear Mr Mukesh Ambani,

You have recently sent a defamation notice to a number of TV channels. Their “crime” is that they aired the press conference held on the 31st October 2012 and 9th November 2012, by Prashant Bhushan and me, live. In our press conference, we presented before the country how you had illegally pressurized the government into increasing gas prices. We also told the country that your associates and your companies have accounts in Swiss banks where black money had been stashed away. Many TV channels aired our expose live. All these TV channels have now received defamation notices from you.

I find it quite perplexing. If you felt that you have been defamed by what Prashant Bhushan and I said, then we are the real culprits and, if you had to send a defamation notice, it should have been to us. The TV channels merely broadcast what we said. Despite this, instead of sending us the defamation notice, you have sent it to the TV channels. It is evident that your sole purpose of sending this notice was to steamroll the TV channels into subservience.

The people of India want to ask you some straight questions:

Is it not true that the list of those who have accounts in Swiss Banks, as received by the Government of India, includes your name and the names of your relatives, your friends and your companies?
Is it not true that a balance of Rs. 100 crores is shown against your name in this list?
Is it not true that you have paid the tax on this amount after this list was received by the Government?
If the above is true, as we suspect it is, it proves that you have admitted your guilt. As per the law of the land, you should be tried and, if the charge of tax evasion is proved, you should be sent to jail.

However, this would never happen. Why? Because the Government of India is intimidated by you. You have been reported as saying that the Congress Party has been bought by you – it is your dukaan, to be precise. You are right. according to some media reports, Mrs. ‪#‎Sonia_Gandhi‬ sometimes travels by your personal aircraft. People believe that Mr. Jaipal Reddy’s ministry was also changed because of your influence.

Why only the Congress? Even BJP and many other parties are in your pocket. Earlier, Mr. Advani used to make a lot of noise about Swiss Bank accounts, but since your accounts have been exposed, BJP has suddenly gone quiet. BJP has not mentioned a single word in the Parliament about your accounts.

It appears that almost all parties are afraid of you. Most leaders are scared of you, too. However, the citizens of this country are not scared of you. All parties could be your dukaan but India is not up for sale. India is ours, it belongs to the people of this country. You can purchase political parties and political leaders with your money but we will not let India be sold.

You say that the TV channels have tainted your reputation by airing our press conference live. That’s wrong. I would urge you to answer this question honestly – Did ‪#‎Prashant_Bhushan‬, myself and the TV Channels defame you or did you defame yourself through your own misdeeds?

1. In 2002, you gave 1 Crore shares with a market price of Rs. 55 per share to Mr. ‪#‎Pramod_Mahajan‬ at just Rs. 1 per share. This was a straight bribe to get “Full Mobility”. When you were caught, you took back the shares. Presently, the matter is In court. Didn’t you defame yourself by doing this?

2. You have made your multistoreyed residence on ‪#‎Wakf_land‬. This land had been set aside for an orphanage. You have stolen the right of poor and orphaned Muslim children. Didn’t you defame yourself by doing this?

3. A few gas wells belonging to the Country were allotted to you in 2000. You were supposed to extract gas and give it to the government. The gas belongs to us, the people of India. We are the owners of this gas. You were only a contractor appointed to extract the gas. However, cleverly you became the owner of the gas. You started “selling” the gas to the government.

Because the Congress is in your pocket, it always bowed before your bullying. The Congress kept increasing the price of gas under your pressure and the nation kept wailing. Because of you, the prices of electricity, fertilizer and cooking gas kept rising. When it crossed all limits, Mr. ‪#‎JaipalReddy‬ opposed you. He was the Minister for Oil and Gas at that time. You got Mr. Jaipal Reddy transferred. Because of you many things have become increasingly expensive in India and the people are groaning under the load of these high prices. Do these shenanigans suit you? Do such acts not defame you?

The list of such illegal acts done by you is quite long.

The majority of the traders, businessmen and industrialists want to do their work honestly. But the system forces them into wrongdoings. But when a businessman like you brazenly subverts the system for his personal benefit, the entire industry and business world gets a bad name.

You are on one side with immense wealth. On the other side are the people of this country. The people have now awakened. Fire is raging in their heart. History is witness that whenever there has been a clash between money and such rage, the rage has won.

Kindly do not try to intimidate the media of this country. There may be some mediamen who may have done wrong things themselves. Such media-persons may succumb to your pressure. However, the majority of media persons keep the interest of the Country at heart even today. They are not going to capitulate so easily. History is witness that whenever the judiciary, bureaucracy and legislature crumbled, it is the honest fourth pillar, comprising such media-persons that kept democracy alive.

You have invested in some media houses directly or indirectly. It is possible that these media houses do your bidding. However, the journalists working for such media houses will not barter their integrity so easily.

What is your dream? Do you want to become the world’s richest person through dishonesty? Suppose you became the owner of all the wealth in this country. Would that make you happy? Happiness does not increase by accumulating more and more wealth. Happiness comes with sacrifice. If you stopped doing business dishonestly and contributed your wealth for the development of the nation, this country will remember you with pride forever.

With regards,

Arvind Kejriwal

A Reaction to Arvind Kejriwal

A Short Note on Arvind Kejriwal's Speech at CII

by Shyamal Bhattacharya

I am a bit disappointed to hear the speech Arvind gave at CII. Over all it was ok, but I expected some deeper  insight into the Economic Policy he somewhat half spelt out, or in what he thought govt.'s  sphere of responsibility is limited to. Let me remind him his own beautiful declaration that it is govt.'s responsibility to supply life-line water, electricity, shelter, education, health, food, dress and public transport in the first place. Capitalism or crony capitalism or socialism, does not matter.  Whats in name after all? But when a govt. policy puts all those above mentioned basic services and goods at the mercy of market, controlled by private players, thats not what Arvind actually meant to do, I hope. As for job creation role of the govt, there is huge scope which was overlooked. Now suppose, if government takes care of all those fields particularly for the marginal people, plus infra structure, a huge number of jobs can be created. A county's development is not measured just by the index of growth, rather by Human Development Index. I hope, Arvind and his think tanks take note of an aam admi's suggestions into their consideration. AAP is an event, a real ray of hope that has touched the hearts across the country.... to keep it alive and make it really a people's movement for  2nd liberation of our country.....we are  with AAP.... but AAP too has to be with us.
